The Controller of the personal data processed through the website www.ogimy.com is the Company for Trade and Services ГУЛЦАН ДОО Скопје (abbreviated name: ГУЛЦАН ДОО Скопје).
In this Privacy Policy, the terms “Controller”, “we”, “us”, “our website”, “the mobile version of the website”, and “our application” refer to ГУЛЦАН ДОО Скопје.
In accordance with the activities it performs, the Controller processes personal data pursuant to the applicable regulations in the Republic of North Macedonia. • What types of personal data do we collect and process?
When you register for and use the platform, we may process the following personal data:
User profile data: first and last name (the information you, as a user, entered during registration, for the accuracy of which you are responsible), date of birth (not public; used for a birthday greeting and, when enabled, the birthday OgiPoints reward), telephone number (the contact telephone number you entered; if you do not want it to be displayed in the listing or made public, you select the option “Do not display the phone number in the listing” when registering a listing. In that case, your telephone number will not be displayed publicly and will be used solely for the purpose to which you agreed during registration), email address (your email address, which is not public and cannot be accessed by third parties; it is used solely for the purpose to which you agreed during registration), address and/or place (location) of sale (the city where the product being sold/the service being offered is located), transaction account;
Technical data: IP address, access and login data, platform usage data, and internet browser and device information;
Communication data: messages sent through the private messaging system between users, user support, and communications with the Controller.
• Purposes of personal data processing
We process your personal data for the following purposes:
• Creating and maintaining a user profile (in the form and with the content selected by you);
• Sending a birthday greeting and, when enabled, adding the configured OgiPoints birthday reward to your account;
• Publishing and managing listings (in the form and with the content selected by you) so that interested buyers may contact you regarding the item/service being advertised;
• Enabling communication between users through private messages;
• Verifying the identity of users;
• Ensuring security and preventing misuse;
• Fulfilling legal obligations;
• Resolving complaints and providing user support;
• Improving the functionality of the website and application and sending system-functional email messages, such as notifications of a published listing, a completed payment, and similar matters. These messages are not promotional and are not used to send promotional messages;
• Your personal data will be used for digital marketing purposes only if you have granted permission for this.
We use the data entered exclusively for the purpose for which it was entered and are not responsible for the accuracy of the information entered.
Personal data is not provided to third parties except where necessary to provide the platform's services (for example, hosting, payment services, technical support, and similar services) or where a legal obligation exists. In all such cases, the relationship with the third party is governed by an appropriate personal data processing agreement that ensures compliance with personal data protection regulations.
When creating a profile/registering a listing, the user decides whether or not the telephone number will be displayed. Your email address is never displayed publicly unless the advertiser decides to add it to the listing description. The data entered for a listing is used to publish the listing in the form and with the content determined by the advertiser.
• How is your personal data used?
If you use the website and application to create a user profile or as an advertiser who posts a listing
When creating a user profile/registering a listing, we process the data you voluntarily provide when completing the form for creating a user profile/registering a listing, solely for the stated purposes.
In addition, as a result of the access itself to the website and application, we process technical data relating to the device from which you access our website, data about your internet browser, your IP address, and the location of the device.
If you visit the website as a visitor browsing listings
When you visit our website as a visitor, the Controller collects technical data relating to the device from which you access our website, data about your internet browser, your IP address, and the location of the device.
If, as a user, you use the website/application and wish to contact an advertiser through the “send message” field
When you use the website/application to communicate with the person who posted a listing, your first name, last name, email address/telephone number that you entered will be visible to the advertiser so that you can continue communicating about the item. We accept no responsibility for and have no access to communications between the advertiser and the buyer. The data provided will be used solely for that purpose and will not be used for any other purpose for which no consent has been given.
• Legal basis for processing
Personal data is processed on the basis of:
• Performance of a contract, namely use of the platform's services (e.g., registration, publication of a listing);
• Fulfillment of the Controller's legal obligations;
• The user's consent (e.g., direct marketing);
• Legitimate interest in ensuring the security and proper operation of the platform.
• Processors and transfer of personal data
The website and application are hosted in Germany through an external service provider (Hetzner Online GmbH), with which the Controller has concluded an appropriate personal data processing agreement. The Processor applies appropriate technical and organizational measures to protect personal data in order to ensure the confidentiality, integrity, and availability of the data and the resilience of the processing systems and services. Because the data is processed in a Member State of the European Union, the level of protection is considered adequate under the applicable personal data protection regulations.
• Cookies and social networks
The website uses Cookies, which are small text files stored on your computer. Cookies are used to optimize our services, enable the system to function properly, and improve use of the platform. This information is anonymous and does not contain personal data. The website user may save, restrict, or disable these cookies. The Controller retains personal data only for as long as necessary to fulfill the purposes for which it was collected and processed and in accordance with the legal obligations applicable to the Controller. After the applicable retention periods expire, personal data is permanently deleted, anonymized, or processed in a manner that no longer permits identification of the data subject.
• What are your rights regarding the protection of personal data?
As a user of our website and application, your rights in connection with the privacy policy and protection of personal data are as follows:
Right to information - You have the right to be informed which personal data is processed about you and the purposes and legal basis of that processing.

• Processing of personal data for direct marketing purposes
Direct marketing is any form of communication carried out by any means in accordance with the latest technological developments for the purpose of sending advertising, marketing, or promotional content directed specifically to the User in the form of email, SMS, Viber messages, telephone messages, and similar communications.
Pursuant to Article 11 of the Law on Personal Data Protection, the Controller processes personal data for direct marketing purposes exclusively after obtaining the data subject's prior consent. This consent is obtained by selecting the option “I agree to receive advertising content such as offers and news from www.ogimy.com” when creating a user profile and/or when the user registers a listing.
We limit direct marketing to a reasonable and proportionate level and send relevant notifications solely in accordance with users' interests and previous searches on the website.
Under the Law on Personal Data Protection, the data subject has the right at any time, free of charge and using simple means, to withdraw consent to the processing of their personal data for direct marketing purposes.
